Data protection policy regarding personal data art. 13 Reg. EU 2016/679 - GDPR

Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, otherwise known as the General Data Protection Regulation (hereinafter GDPR), establishes the legal framework applicable to the processing of personal data. The GDPR strengthens the rights and obligations of data controllers, processors, data subjects, and data recipients. Subsequently, to implement the amendments of the GDPR, Law No. 78-17 of 6 January 1978 known as the Data Protection Act was amended by Law No. 2018-493 of 20 June 2018 and Ordinance No. 2018-1125 of 12 December 2018 regarding data protection.

  1. DATA CONTROLLERS
    The "data controller" refers to the natural or legal person who determines the purposes and means of processing personal data. Under this policy, the data controller is Le Boudoir d’Arété, legal headquarters Venice, Sestiere San Marco 3168, 330124, P.IVA 04783120274 (hereinafter Le Boudoir d’Arété).

  2. CATEGORIES OF COLLECTED DATA
    « Personal data »: any information concerning an identified or identifiable natural person (data subject); a person who can be identified, directly or indirectly, notably by reference to an identification number or to one or more specific elements, particular to their physical, physiological, mental, economic, cultural or social identity, is considered identifiable,
    « Enriched data »: enriched personal data contrasts with the notion of « raw » personal data provided by the data subject. These are the data that are generated by the data controller. It may also include inferred and/or derived data created by the data controller based on the data « provided by the data subject »,
    « Processing of personal data »: any operation or set of operations performed or not by automated means and applied to personal data, such as collection, recording, organisation, storage, adaptation or alteration, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, reconciliation or interconnection, as well as locking, erasure or destruction,
    « Personal data breach »: a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of personal data transmitted, stored or otherwise processed, or unauthorised access to such data.
    The Boudoir d’Arété may, with your consent and if included in the contact form, process your health data in the case of food intolerances or allergies.
    The "data subjects" are individuals who can be identified, directly or indirectly, by reference to the personal data that is collected by the data controller, that is to say, within the framework of this policy, all the contacts of Le Boudoir d’Arété linked to its clients and prospects regardless of their status.

  3. PURPOSE OF PROCESSING
    Your personal data will be processed in accordance with Article 6) letter f) of Regulation EU 2016/679 for:
    – responding to information requests from the form,
    – subscribing to the Le Boudoir d’Arété newsletter,
    – enrolling in the selected training course.
    The processing of data is based on Article 6, paragraph 1, letter f).

  4. RECIPIENTS OF DATA
    ​The recipients of the data refer to natural or legal persons who receive communication of the personal data. We ensure that the data collected and processed in the context of our relationships with our clients and prospects is only accessible to authorised internal and external recipients, and in particular, to the following recipients:
    – Our service providers or support services (e.g. IT service provider);
    – Our providers for the chosen training courses;
    – The competent authorities in the event that we are required to share certain data with legal auxiliaries, with services responsible for internal control procedures, etc.
    Regarding internal recipients, we decide which recipient will have access to which data according to an authorisation policy and we ensure that they are subject to a confidentiality obligation.
    Regarding external recipients, we inform you that the personal data of our contacts with our clients and prospects may thus be communicated to certain of our service providers or to any authority legally entitled to know (notably tax and social authorities). In this case, Le Boudoir d’Arété is not responsible for the conditions under which the staff of these authorities access and use the data.

  5. TRANSFER OF PERSONAL DATA OUTSIDE THE EU
    Personal data is not processed outside the EU (EEA).

  6. RETENTION PERIOD
    As a rule, data relating to our clients and prospects must be retained for the time strictly necessary for managing the business relationship. After the set deadlines, the data is either deleted or retained after being anonymised, notably for statistical purposes. They may be retained in the event of pre-litigation and litigation.

  7. NATURE OF THE SERVICE AND REFUSAL
    The provision of data for the purposes mentioned in point 3 is necessary for the pursuit of your legitimate interest, that is to say, the legitimate expectation of receiving a response to the request sent. If you do not provide it, it will be impossible to receive the requested services.

  8. YOUR RIGHTS
    When we process your personal data, you acquire a number of rights that you can exercise at any time. Below, we provide an overview of these rights, as well as what they mean for you. Right of access and rectification
You have the right at any time to access, rectify or update your data. We understand the importance of this right, to exercise it, we invite you to write an email to leboudoirdarete@gmail.com.

Right to object to data processing
You have the right to object at any time to the processing of your personal data. To do this, we invite you to write an email to leboudoirdarete@gmail.com.

Right to lodge a complaint with the competent authority
You have the right to file a complaint directly with the competent authority regarding how we process your personal data.

Right to data portability
Your personal data can be transferred, copied or transmitted electronically. This right can only be exercised by you when:
a) the processing is based on your consent;
b) the processing is carried out by us to perform a contract;
c) the processing is carried out using automated tools.

Right to limit processing
You have the right to request the limitation of the processing of your personal data if :
a) you believe that your personal data is incorrect ; or
b) the personal data has not been processed in accordance with the provisions of the law, but instead of asking us to delete it, you prefer that we limit its processing ; or
c) we no longer need your personal data that we have collected, but you request it to assert or exercise a right or to defend yourself in legal proceedings ; or
d) you object to the processing of your personal data and are waiting to see if your interests in support of this objection prevail over the grounds which legitimise the processing of your data.

Right to object to data processing

Right to erasure
You have the right to request the deletion of your data if:
a) your personal data is no longer necessary for the purposes for which we collected it; or
b) you withdraw the consent previously given for the processing of your personal data and there is no other legal reason to continue processing this data; or c) you object to the processing of your personal data for direct marketing purposes; or
d) you object to the processing of your personal data for the legitimate interests of Le Boudoir d'Arété (such as improving the overall user experience on the sites);
e) the personal data has not been processed in accordance with the provisions of the law; or
f) your personal data must be deleted in accordance with the provisions of the law.

This site has no control over third-party cookies, which are entirely managed by third parties. Google Analytics: Google's analysis tool which, through the use of cookies (performance cookies), collects anonymous browsing data (IP addresses truncated to the last octet) and exclusively aggregated for the purpose of examining site usage by users, generating reports on site activities, and providing other information, including the number of visitors and the pages visited. Google may also transfer this information to third parties when required by law or when these third parties process the information on behalf of Google. - Youtube: this is a platform owned by Google, for sharing videos, which uses cookies to collect information about users and browsing devices. The site's videos do not transmit cookies when accessing the page, as the "advanced privacy (no cookies)" option has been set whereby YouTube does not store information about visitors unless they voluntarily play the video.

Social Network Plugin
This site also integrates social network plugins and/or buttons, in order to allow easy sharing of content on your favourite social networks. These plugins are programmed not to install cookies when accessing the page, in order to protect users' privacy. Ultimately, cookies are only installed, if provided by the social networks, when the user makes effective and voluntary use of the plugin. Keep in mind that if the user browses while logged into the social network, they have already consented to the use of cookies transmitted via this site when they registered with the social network.
