These General Terms and Conditions of Sale (hereinafter "GTC") apply, without restriction or reservation, to all sales concluded between the company The Boudoir of Arète (hereinafter "The Seller") and consumers or non-professional buyers (hereinafter "The Client") wishing to acquire the products offered for sale on the website leboudoirdarete.fr (hereinafter "the Site").

2. Protection of Minors and Alcohol Abuse
⚠️ MANDATORY LEGAL WARNING:
Alcohol abuse is dangerous for health, to be consumed in moderation.
In accordance with Article L. 3342-1 of the Public Health Code, the sale of alcohol to minors under 18 years of age is prohibited.
By placing an order on the Site, the Client expressly certifies that they have the legal capacity and the required legal age (18 years old) to purchase the offered alcoholic products. The Seller reserves the right to request identification upon delivery.
3. Products and Availability
The products offered for sale are Italian wines, spirits, and fine grocery products.
Descriptions: The main characteristics of the products (origin, grape varieties, volume, potential allergens) are presented on each product sheet. The photos are illustrative and non-contractual.
Availability: The product offers are subject to stock availability. In the event of a product being unavailable after the order has been placed, the Client will be informed by email and will be refunded within a maximum of 14 days.
4. Rates and Prices
The prices of the products are indicated in Euros (€) and are understood to be:
All Taxes Included (ATI) at the current French VAT rate.
Excluding delivery charges, which are calculated and displayed before the final validation of the order.
The Seller reserves the right to change their prices at any time, but the products will be billed based on the rates in effect at the time of order validation.
The shipping cost for delivery in mainland France is inclusive of tax :
from €11 flat rate for 3 kg up to €18 for 9.9 kg in weight, which means a box of six bottles maximum or equivalent weight
€30 flat rate for between 10 and 20 kg in weight
Direct delivery is planned within 40 km of Verteillac, with charges calculated based on the kilometres.
Free delivery within 20 km of Verteillac (24320).
Free delivery for any purchase worth 250 euros including VAT.
5. Order and Payment
5.1 Placing the order
The Customer validates their order according to the "double click" process:
Selection of products and addition to the basket.
Validation of the basket, entry of delivery details and choice of payment method.
Acceptance of the T&Cs and final confirmation (payment click).
A confirmation email summarising the order is sent to the Customer as soon as possible.
5.2 Payment terms
Payment is due immediately upon ordering. Payment is made by credit card (via the secure systems Stripe and PayPal). The Site uses an SSL security protocol to protect banking data.
6. Delivery and Receipt
6.1 Areas and Timeframes
Le Boudoir d'Areté delivers in mainland France. The indicative delivery times are 3 to 5 working days from dispatch.
The order is prepared within 48 hours of receiving the order, unless placed on a Saturday, Sunday or public holiday: in this case, allow at least an additional 24 hours.
The logistics provider is La Poste Colissimo/Chronopost.
6.2 Checking parcels (Important notice for wine)
It is the Customer's responsibility to check the condition of the packaging and the conformity of the products upon receipt.
In the case of broken bottles or damaged parcels, the Customer must refuse the parcel or make precise and specific reservations on the carrier's delivery note.
The Client must inform the Seller within 48 hours by email at the following address: leboudoirdarete@gmail.com.
7. Right of Withdrawal
In accordance with Article L. 221-18 of the Consumer Code, the Client has a period of 14 calendar days from the receipt of their order to exercise their right of withdrawal, without having to justify reasons.
Important exceptions:
Perishable products: Certain fresh or perishable gourmet grocery products cannot be subject to a right of withdrawal.
Opened products: Bottles of wine or jars that have been opened, uncorked or damaged by the Client after delivery will not be taken back or refunded for hygiene and health protection reasons.
Return costs are the sole responsibility of the Client. Products must be returned in their original packaging and in perfect condition to the registered office address. Refunds will be made within 14 days following the receipt of the returned products.
8. Legal Warranties
The products sold benefit from:
The legal warranty of conformity (Articles L. 217-3 and following of the Consumer Code).
The legal warranty against hidden defects (Articles 1641 and following of the Civil Code), allowing for the refund of a "corked" wine or one unfit for consumption (subject to expertise and the return of the nearly full bottle with its original cork).
9. Personal Data (GDPR)
The Seller undertakes to protect the personal data of the Client. The information collected is necessary for the management of the order and for billing. It is in no case transmitted to third parties without prior agreement.
In accordance with the GDPR, the Client has the right to access, rectify and delete their data by writing to: leboudoirdarete@gmail.com.
10. Disputes and Applicable Law
These general terms and conditions are subject to French law.
In the event of a dispute, the Client agrees to contact the Seller first in order to find an amicable solution. If no solution is found, the Client has the option to resort free of charge to a consumer mediator:
